Other Rights
Several other rights contained in the Canadian Charter of Rights and Freedoms are important considerations in drug offenses. The right to be free from Arbitrary Detention protected by section 9 is sometimes violated by the police when they arrest an individual without proper grounds to believe they have committed an offense. The police sometimes arrest everybody at a grow op, believing that all must be involved, despite no evidence linking them specifically. In such cases, our lawyers have secured acquittals for our clients.
In addition, the Right to a fair trial including the right to make full answer in defense of the charges includes the right to full disclosure of the police investigation. Sometimes the police destroy evidence or the prosecutor fails to provide it to the defendant. This has resulted in several charges being thrown out against Tessmer Law clients.
